Restaurant owner wins discrimination case with Romanies
PRAGUE- Karel Svoboda, the owner of a restaurant in Nachod, east Bohemia, today won the court dispute in which he was accused of racial discrimination against Romanies.
The court ruled that Svoboda need not apologise to local Romanies or provide any financial compensation for his personnel's refusal to serve them, allegedly due to their colour of skin, as the plantiffs asserted in their complaint.
The definitive verdict was delivered by the Prague High Court today in the appeals proceedings. The court thus changed last year's verdict of the Hradec Kralove Regional Court, according to which Svoboda was to sent a letter to the Romanies with his apology and pay each of them 20,000 crowns as compensation.
Today's verdict cannot be further appealed, but it is possible to take the case to the Supreme Court.
The incident took place in February, 2002, in the Sport restaurant in Nachod. Romanies, accompanied by a Romany adviser from the district office, decided to check whether racial discrimination was taking place in the restaurant.
When they occupied a table, a waiter told them that it was reserved for a group of footballers. Svoboda says that they could have changed to another table, but according to the Romanies, the waiter prevented them from doing so, saying that he was ordered by Svoboda not to serve Romanies as otherwise he would lose his job.
Unlike the first-instance court, the appeals court upheld the defendant's complaint and cancelled its ruling.
The court stated that Svoboda had proved that no racial discrimination took place and that he treated all his guests equally, regardless of their skin colour.
The court pointed to the testimony of witnesses who said that another group of Romanies was being served in the restaurant at the same time.
According to the verdict, each of the four plantiffs should pay a 122-crown court fee in connection with the hearing of their case by the Hradec Kralove Regional Court. Additional court fees are to be calculated.
